Terms of Service
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the mail migration service (the "Service") provided by Gyvit Technologies ("Gyvit," "we," "us"). By connecting an email account to the Service or otherwise using it, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. The Service
The Service migrates email messages, folders, and related mailbox data from a source email account that you designate (for example, a Microsoft 365 or Outlook.com mailbox) to a destination mailbox hosted by Gyvit. The Service accesses your source mailbox only with your explicit authorization, granted through the source provider's consent flow (for example, Microsoft's OAuth consent screen).
3. Your Authorization and Responsibilities
- You represent that you are authorized to access and migrate the mailbox data you connect to the Service.
- You are responsible for the accuracy of the account details you provide and for maintaining the confidentiality of your Gyvit account credentials.
- You may revoke the Service's access to your source mailbox at any time through your source provider's account settings; revocation stops further migration activity for that account.
4. Data Handling
Mailbox data is accessed solely to perform the migration you request. How we collect, use, and protect data is described in our Privacy Policy, which is incorporated into these Terms by reference.
5. Acceptable Use
You agree not to use the Service to migrate data you have no right to access, to transmit unlawful content, to interfere with or disrupt the Service, or to attempt to gain unauthorized access to any system or account.
6. Availability and Changes
We strive to keep the Service available and reliable, but it is provided on an "as is" and "as available" basis. We may modify, suspend, or discontinue the Service, or update these Terms, at any time. Material changes to these Terms will be reflected by the "Last updated" date above; continued use after changes take effect constitutes acceptance.
7. Disclaimer of Warranties
To the maximum extent permitted by law, Gyvit disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every message will migrate without alteration; you should retain access to your source mailbox until you have verified the migration results.
8. Limitation of Liability
To the maximum extent permitted by law, Gyvit will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising out of or relating to your use of the Service.
9. Termination
We may suspend or terminate your access to the Service for violation of these Terms. You may stop using the Service at any time.
